A recent case involving a former Austin Independent School District (AISD) executive highlights why careful legal defense matters when careers and reputations are on the line. After a detailed review by the Travis County District Attorney's Office, prosecutors declined to pursue felony charges against the former executive, citing insufficient evidence.
The allegations involved internal recordkeeping for AISD’s employee wellness program. Specifically, investigators accused the former executive of improperly modifying a digital tracking log used to manage distributions of staff wellness gift cards, including entries tied to more than $36,000 in stored cards and a $135,000 bulk order.
Defense Response Highlights Good Faith Actions
However, defense attorney Brian Roark, founding partner at Botsford & Roark, pushed back on the claims. He explained that the adjustments were made in good faith to clarify discrepancies and maintain accurate records, reflecting the client’s understanding that many of the gift cards had already been distributed and that inventory control had shifted.
“Every action she took, statement made, and document she provided was accurate and true to the extent of her knowledge and understanding at that time,” Roark said. “She never intentionally provided any false information.”
The former executive, who has spent more than 17 years in education and administration at AISD, maintained her innocence throughout the investigation. Following the DA’s review, no charges were filed.
“This case validates what [the executive] and our team have maintained from the beginning — that she acted lawfully, transparently, and in good faith,” Roark said. “It is unfortunate that her life and career had to be disrupted based on allegations that were not supported by the facts.”
